APPEAL COURT AFFIRMS MUBI NORTH LAWMAKER, PAUL SAMUEL’S ELECTION

The Court of Appeal Abuja Division has dismissed an appeal filed against member representing Mubi North constituency at the Adamawa State House of Assembly, Hon. Paul Samuel.

According to the court, the appeal filed by the candidate of the PDP for Mubi North constituency in 2023 general poll, Hon. Ishaka Yusuf (aka Dangote) constituted an abuse of court process.

The court dismissed the appeal on Wednesday, while delivering judgement in Hon. Dangote’s appeal, constesting the judgement of Election Petition Tribunal delivered in Yola, Adamawa state.

While delivering judgement in an appeal No: CA/YL/ EP/ AD/SHA/ 14/ 2023, Justice Olabode Abimbola Adegbehingbe, said” that appellant appeal is an abuse of the process of the court, as they appealed against a non-existent order, purportedly made by the tribunal”.

Justice Adegbehingbe, said, ” Once a court is satisfied that the processes before it are an abuse of its processes and orders, which in effect is a direct challenge to its integrity, it should with all urgency exercise its inherent jurisdiction and dismiss the abuse or process”.

Hon. Dangote had earlier alleged that the APC Lawmakers was not duly elected by the majority of lawful votes cast, adding that the poll was marred by irregularities, and sought for its nullification.
