Adamawa State High Court has dismissed a lawsuit instituted against the state government on the three thousand naira tax per cattle head from five hundred naira.
Delivering the Judgement Tuesday, Justice Musa Usman explained that the litigation is lacking in merit as well as null and void.
He affirmed that the state government had followed all necessary procedures leading to the enactment of the law in line with the state Revenue Administration Law.
Justice Usman therefore, urged the plaintiff to appeal the judgement should they feel unsatisfied.
Speaking to newsmen, the Defence Council, Barrister Urbanus Jonathan Konleganijiga pointed out that the government had exhausted all legal means of establishing the new law, having transmitted the bill to the House of Assembly, consequently passed and ultimately assented to by the Governor.
He therefore maintained that the judgement was apt and in consonance with equity, fairness and justice.
On his part, the council to the plaintiff, Barrister Aliyu Abubakr of Ronald C. Emem and Co, said they accepted the judgement in good faith.
According to him, they filed the suit challenging the legality of the new law on the premise that the defendant did not follow proper channel or use acceptable instrument while at it.
With this, the new law on the three thousand naira tax per cattle head in the state is sacrosanct as against five hundred naira earlier being paid.
