An appeal filed by the self aclaimed Candidate of the Peoples’ Democratic Party (PDP), for Yola South Constituency Adamawa State House of Assembly, Hon. Adamu Baba Mustapha against the former Speaker, Rt. Hon. Kabiru Mijinyawa, has been dismissed.
The judgement of the Appeal Court Abuja Division on Friday, has finally dashed the hope of the embattled Candidate to unseat Rt. Hon. Kabiru Mijinyawa and become the member representing the good people of Yola South constituency.
More importantly, the decision of the appellate court has rested the legal tussle on the exalted seat which is currently being occupied by the peoples’ lawmaker and former Speaker who has been striving assiduously to provide quality representation to his teeming electorate.
In its verdict, the court did not only dismiss the appeal brought by Hon. Adamu Baba, but unequivocally declared that the appeal lacks merit and worth nothing other than to be dismissed in its entirety and accordingly dismissed.
Hon. Justice E. Tobi, who delivered the judgement, trashed the appeal for lacking in merit and awarded the cost of N300,000 in favour of the respondent, Rt. Hon. Kabiru Mijinyawa, against the appellant, Hon. Adamu Baba Mustapha.
According to the judge, the appeal is purely a pre election matter and nothing more, nothing less, and that appellant has wested the precious time of court and that of the respondents with an appeal that does not have merit therein.
It worthy to note that during primary election and main election, it is the political party that is solely responsible in nominating and sponsoring of a candidate contrary to what is obtained in the matter at hand. Hon. Adamu Baba’s party, was not excluded in the election conducted on the 18th March, 2023.
In his quest for power, Hon. Adamu Baba, launched his legal battle against the incumbent lawmaker shortly after poll at the National/State Assembly Petitions Tribunal where his petition was thrown into dustbin.
The tribunal on the 29th September, 2023, declared in its judgement that his petition was premised on pre-election matter, and that its lacks jurisdiction to entertain it, and described the petition as incompetent, frivolous and ought to be dismissed in its entirety.
After hitting a rock, Hon. Adamu Baba decided to proceed with his legal battle where approached the appellate court and lodged his appeal with a view to seeking redress and with a hope that it will succeed without even considering its merit.
It turned out be another huge failure for the embattled candidate when the court of appeal in its entirety and consequently ended every battle against the exalted seat in the constituency.
